Ralph,

We are not in the hypothetical, and we never were. In order to retain
access to your third-party-maintained records, so you can get them when
you need them, you will need a contract. A contract will legally tie you
to those records. It will also provide a trail to anyone doing
discovery. You will be as legally tied to them as you were before you
stored them off-site. I am not a lawyer, but as a 20+ year RM
professional, I am qualified to address the legal aspects of retaining
and disposing of records. 

Why not just revise your records retention schedule to reflect your
actual reference needs of the records?
