First of all, I'm not an attorney and I think you'll need one for a proper interpretation of this opinion.  What I believe however is that the Court is considering the question of an email correspondence being considered a contract for purposes of obligating the parties to whatever it is they agreed to, not as a documentation of a transaction (because it could very well be that).
