I would suggest that a statement concerning the ability to accurately
implement a legal hold would be appropriate.  

Our internal and external legal counsel would be very displeased to
learn that we had implemented a technological solution without the
ability to suspend the destruction of materials; especially if the
system proceeded to destroy relevant records after a statement of claim
had been served.
