Our firm, which has been in business since 1927, added retention policy language to our engagement letters starting in 2002. That covers the "go-forward" clients and matters.
For the older stuff, we are trying to locate the larger clients and notify them that we want to destroy their materials for matters that have been closed for more than 10 years. Our General Counsel has provided some guidelines on how to handle materials belonging to those clients/matter who -- after we make the effort to find them -- we're still not able to locate or contact. We'll probably never finish this clean-up, but we are making progress and are chipping away at the backlog.
