Everyone has the legal right to file for a patent for anything. (Perpetual
motion machines are an historic favorite.) The only thing that a patent
application per se may abuse is the applicant's pocketbook. There is no
shame --- nor should there be --- in merely filing a patent application.
Whether or not the application contains anything "new, useful, and
non-obvious" and thus should be granted is determined by individuals who are
thoroughly knowledgeable in the domain of the application; viz. the patent
examiners. Note in passing that "useful" is very broadly interpreted so a
grant turns primarily on "new" and "non-obvious".
Precious few patents repair the hole in the pocketbook. And some that
filled the hole to overflowing were initially derided.
