I'm surprised no one has made the distinction between executive
privilege, an issue of access, and record preservation. The claim seems
to be that executive privilege enables destruction at will of records.
I'm unaware of any records management law or principle that states that
records can be destroyed because they are not accessible to certain
parties. To my knowledge, access and disposition are two distinct
issues. The White House appears to be conflating the two.
