I actually had recent legal counsel that said if we don't have a
retention policy in place in a given circumstance that we can't create
one because doing so would be a change in normal practice, and "that's
what got Arthur Andersen in trouble".

One thing that I think is important in working with attorneys is to
point out the difference between broad records management policy
implementation (in which the above statement would be absurd) and to the
more specific area of litigation hold implementation (where the
statement would make more sense). Attorney's, in my experience, often
confuse the two.
