I would say it depends.  (I am not an attorney and do not give legal advice.  Seek the competent counsel for a legal opinion.)

 - If you are in tax court Mr. Snickers is likely correct.
 - If you are not in tax court, it may depend on whether you are challenged on the requirements associated with the Business Entry Rule.
